Section 1 — General Terms (All Users)

1.1 What is MakaanWale?

MakaanWale is an introduction service only. We connect hosts with tenants — we do not arrange tenancies, manage properties, collect rent, or guarantee outcomes.

Facilitate introductions and provide contact details
Arrange tenancies or manage properties
Collect rent, bonds, or sign agreements
Guarantee tenants, hosts, or outcomes
Provide legal advice or manage disputes

1.2 Our Role

MakaanWale acts as an intermediary only. Once we introduce you, you handle all negotiations, agreements, and disputes directly.

1.3 Fees

Tenants pay: FREE one-time introduction fee (after booking confirmed)
Hosts pay: FREE one-time fee after first confirmed booking
Payment is non-refundable once an introduction has been made
If no booking within 30 days: refund minus 10% admin fee

1.4 Your Responsibilities

You are responsible for all information you provide. All information must be true, accurate, and not misleading. Photos must be owned by you or used with permission. False information may result in listing removal, account ban, or referral to authorities.

1.5 Prohibited Conduct

Provide false or misleading information
Harass, abuse, or threaten other users
Discriminate based on race, religion, gender, or disability
Engage in fraud, scams, or illegal activity
Share someone's private information without consent
Spam or send unsolicited messages
Impersonate another person or business

Violation may result in immediate account termination and possible legal action.

1.6 Limitation of Liability

MakaanWale is not responsible for the quality of listings, accuracy of information, host/tenant behaviour, property condition, financial losses, personal injury, or disputes between parties. In no event shall MakaanWale be liable for more than the amount you paid for the service.

1.7 Governing Law

These terms are governed by the laws of Victoria, Australia. Disputes are handled in Victorian courts, compliant with Australian Consumer Law and the Estate Agents Act 1980.

Section 2 — Tenant Terms

2.1 Your Responsibilities as a Tenant

Negotiate terms directly with the host
Sign an agreement directly with the host
Pay rent on time and follow house rules
Maintain the property and be respectful
Resolve disputes directly with the host

2.2 Verification

We verify basic information only. You are responsible for independently checking host credibility, viewing the property before booking, and making your own decision.

2.3 No Guarantee

We do not guarantee the host will respond or the room will be available
We do not guarantee information is 100% accurate
We do not guarantee the property is safe, clean, or legally compliant

2.4 Disputes

Try to resolve disputes directly with the host first. MakaanWale can mediate but cannot force refunds, arbitrate, or make binding decisions. If unresolved, you may pursue VCAT (Victorian Civil and Administrative Tribunal) or small claims.

Section 3 — Host Terms

3.1 Your Responsibilities as a Host

Provide a safe, accurate, and legal listing
Negotiate and sign agreements directly with tenants
Comply with Victorian tenancy laws and building codes
Respond to enquiries and honour your commitments

3.2 Listing Requirements

Your listing must include an accurate description, minimum 3 high-quality photos, clear pricing, lease length, house rules, and dietary preferences. The property must be legal, safe, clean, and available as stated.

3.3 No Guarantee

We do not guarantee a tenant will apply, book, or move in
We do not guarantee tenants will pay or respect the property
We do not guarantee tenants will stay the full term

3.4 Disputes

Resolve disputes directly with the tenant. Document all communications. MakaanWale can mediate but cannot force decisions. If unresolved, pursue VCAT or small claims court.

We respond to complaints within 3 business days. We investigate and provide resolution where possible, but cannot force refunds, arbitrate disputes, or settle financial claims between users.

Booking — Confirmed match and agreement
Introduction — When we provide contact details to both parties
Introduction Fee — One-time payment for the connection service
